® Kidstuff, with the assistance of CG Lawyers, was able to rely on its trade mark registration to stop another business from using the Kidstuff domain name address in its metatagging to attract internet traffic to its website
® When CG Lawyers applied for registration of this trade mark on behalf of the client, IP Australia initially refused to accept the application because there is a small town in France called Metz that produces concrete products. Instead, IP Australia sought extensive evidence from our client about its use of the trade mark, which would have cost our client time and money. We pointed out to IP Australia that it should not maintain its objection because our client already had METZ registered as a word mark in relation to such products. IP Australia conceded this point and the mark was accepted for registration without the need for further evidence.
® Our client has used this logo for a period of time. Fortunately and with CG Lawyers' assistance, it applied for registration of it as a trade mark prior to its competition which subsequently sought to do so, but the competition's application was rejected by IP Australia because it was later in time to our client's application.
® Our client has been able to rely on the Australian trade mark registration to apply for international trade mark registration via the Madrid Protocol, relying upon the Convention Priority that is available in relation to Convention countries if the international trade mark application is made within 6 months of the local (Australian) application.
® One of the registered trade marks of this client's portfolio of trade marks was infringed. CG Lawyers sent a letter of demand to the infringer citing our client's registered trade mark and within a month or two they had stopped selling product bearing the infringing trade mark. Sometimes a registration is a hassle with which competitors don't want to be troubled.
