Lemon & Lime Design
This client needed advice about whether she should apply for a trade mark in her 'lemon' and 'lime' corporate colours or in just black and white. Colour was obviously very important to her branding. CG Lawyers advised her to apply for registration in black and white because under section 70 of the Trade Marks Act (Commonwealth)when a trade mark is registered without limitations as to colour, it is taken to be registered for all colours. So once registered Lemon & Lime Design would be covered for all colours including, but not limited to, the corporate ones.

Metz
Client website: www.metz.net.au (opens in a new window)When CG Lawyers applied for registration of this trade mark on behalf of the client, IP Australia initially refused to accept the application because the small town of Metz in France produces concrete products. Instead, IP Australia wanted extensive evidence from our client about its use of the trade mark, which would have cost our client time and money. We pointed out to IP Australia that it should not maintain its objection because our client already had METZ registered as a word mark in relation to such products. IP Australia conceded this point and the mark was accepted for registration without the need for further evidence.

Cafe Ideas

Fortunately, and with CG Lawyers' assistance, it applied for registration of CAFEIDEAS as a trade mark prior to its competitor who subsequently sought to do so. The competition's application was rejected by IP Australia because our client's application was submitted first.

Thirst for Life

We cited our client's registered trade mark and within a couple of months the infringer had stopped selling product bearing the infringing trade mark. Sometimes a registration is a hassle with which competitors don't want to deal.

However CG Lawyers was able to advise her about keeping ownership of such a valuable asset separate from her trading activities.
As a result and on the advice of her accountant a trustee of a trust applied for registration of the trade mark and will license her trading company to use it.
This means her branding is safe.
